The following is the basis of the judgment:
The court hearings found that since 2016, former associate professor He Jiankui of Southern University of Science and Technology learned that human embryo gene editing technology can obtain commercial benefits, that is, he conspired with Zhang Renli, a medical institution in Guangdong Province, and Qin Jinzhou, a medical institution in Shenzhen. In the context of relevant regulations and medical ethics, the name of human embryo gene editing technology that has not been rigorously verified for safety and effectiveness is still used in assisted reproductive medicine, in the name of babies who can produce immune AIDS by editing the human embryo CCR5 gene.
He Jiankui and others forged ethical review materials and recruited men to carry out gene editing and assisted reproduction for multiple couples of HIV-infected persons. By means of impostor and concealing the truth, gene-edited embryos were passed through assisted reproduction technology by an unknown doctor. Transplanted into the human body, causing 2 people to become pregnant, giving birth to 3 gene-edited babies.
The court held that the three defendants failed to obtain a doctor's qualification and pursued fame and fortune, deliberately violated the relevant national regulations on scientific research and medical management, crossed the scientific and medical ethics bottom line, and rashly applied gene editing technology to human assisted reproductive medicine, disrupting medical treatment. The management order is serious and its behavior has constituted the crime of illegal medical practice.
Due to the personal privacy of the persons involved, the court did not openly hear the case.
According to Xinhua News Agency, in accordance with relevant regulations, Guangdong Province has seriously dealt with and held accountable the units and personnel involved. The health administrative department has included relevant persons involved in the "black list" of human reproductive technology violations and violations, and barred them from engaging in human assisted reproductive technology services for life. The competent science and technology department has imposed administrative treatment on the persons involved in the case for life-long bans from applying for administrative review and approval of human genetic resources in China, and for life-long bans from various types of scientific research projects at all levels for financial support. The competent science and technology department and the health and health administration department respectively instructed the units involved to improve the scientific research and medical management system, and strengthen the supervision and management of relevant employees.
